Mother Sues Meta and ByteDance Over Son's 'Subway Surfing' Death
A New York City mother, Norma Nazario, is suing Meta Platforms and ByteDance, alleging their social media platforms, Instagram and TikTok, contributed to her 15-year-old son's death while 'subway surfing'. Zackery Nazario died on February 20, 2023, after climbing atop a moving train and falling between subway cars. His mother claims the companies 'goaded' him into the dangerous stunt by addicting him to their platforms. In 2024, at least six people died from subway surfing in New York City. The lawsuit seeks wrongful death, product liability, and negligence claims, asserting the companies should have foreseen and prevented such behaviour. A judge dismissed claims against the Metropolitan Transit Authority, stating common sense should have warned Zackery of the danger. There are no indications of negotiations between the companies and the mother. Norma Nazario aims to prove that Meta and ByteDance targeted her son due to his age. The lawsuit, dismissed against the MTA, now focuses on holding the tech giants accountable for their role in the fatal incident.
