Dutch gambling oversight enacts modifications for penalty impositions
The Kansspelautoriteit, the Dutch gambling regulator, has announced a new fining regime for licensed companies, effective from January 1, 2025. The new policy, outlined in a recently issued document, aims to provide clarity to parties under the regulator's supervision and motivate regulated entities to comply with the strict rules in the Dutch gambling market.
Michel Groothuizen, the newly-appointed Chairman of the Board of the Kansspelautoriteit, commented on the new fining regime on the watchdog's official website. He explained that the regulator has learned from the previous year and, since the market has become regulated, it can now issue better guidance to participating companies. The new policy, according to Groothuizen, is a testament to the regulator's gained experience and its ability to issue a well-considered fine policy.
The new fining regime is based on the regulator's experience and the current state of the regulated market. It outlines five categories of offenses, each leading to different penalties depending on the severity of the issue. The basic penalty in the first category is €500, but it can reach up to €2,000,000 in the severest cases. The regulator has the authority to impose a fine of 3% on the guilty party's gross turnover.
The new document offers more clarity into the fining regime for regulated entities in the Dutch gambling market. It is designed to help these entities understand how the regulatory levers work. Groothuizen hopes that the new policy will motivate regulated entities to avoid fines and contribute to maintaining the integrity of the Dutch gambling market.
The Netherlands has strict rules about advertising, bonus use, and unlicensed gambling. The new document is intended to ensure that regulated entities in the market comply with these rules. Previously, the regulator had issued a separate document explaining how fines are imposed on illegal gambling operators and products.
The new fining regime is a part of the Kansspelautoriteit's ongoing efforts to ensure compliance and maintain the integrity of the Dutch gambling market. It is expected to motivate regulated entities to comply with the strict rules and contribute to a fair and responsible gambling environment in the Netherlands.
