Discussing the Necessity of EU Regulation for Broad AI Systems

One of the key points of discussion will be the recently adopted voluntary Code of Practice for GPAI. As of August 2, 2025, key obligations for GPAI models under the AI Act began applying, ahead of full implementation in 2026. Industry experts view the Code as potentially the best framework globally for managing systemic AI risks, possibly serving as a foundation for international AI governance standards. However, concerns have been raised about strict liability rules or overly burdensome regulations potentially increasing litigation costs, legal uncertainties, and hindering innovation.
Another critical aspect of the debate revolves around liability relating to AI-caused harm. The appropriate framework for liability is a subject of ongoing discussion, with options including fault-based liability rules versus shifting to strict liability for high-risk AI.
The EU AI Act, including its amendments for GPAI, is widely viewed as a potential global regulatory benchmark, akin to the GDPR for data protection. Since the EU is the first major jurisdiction to enact comprehensive AI regulation, its approach may influence legislative and self-regulatory efforts worldwide.
The French presidency has proposed expanding the EU's draft law for regulating high-risk AI tools to include a new class of systems: General-Purpose AI systems. However, opponents argue that this broad-brush approach may capture a swath of systems not intended for high-risk use cases.
